buying property legally in bulgaria

Legal, property law, appointed solicitors, legal translators, Bulgarian
property law, Deeds, deposit payments.

When investing overseas, but specifically a property with a garden, an
apartment or a plot of land in Bulgaria, you will be advised to purchase
the property either as an individual or as a company.

When deciding to buy your home in Bulgaria you will have to acquaint
yourself with the legal formalities of Bulgarian law and the property
buying procedures of Bulgaria and the legislation in the Bulgarian
National Constitution of 1991 that enables a foreign person to legally
acquire land through the formation of a Bulgarian company.

We are here to offer advice and help to guide you at every stage of
your purchase.

Bulgarian Company formation

If you are buying a property with land you will have to form a Bulgarian
company and become a shareholder. A Bulgarian company has
shareholders (normally you) and it is the company that owns the deeds
of the property. You in turn own the Bulgarian company.

Malkoto selo's complete legal service will set up all the necessary legal
documents you require if forming a Bulgarian company.

Tax law and finance

There are a number of very important points that you will be made very
clear of during the purchase proceedings, including: Tax, personal tax,
capital gains tax, corporation tax, deeds, contracts, land registry,
notary, bank finances, Bulgarian developers deposits, Bulgarian
mortgages, cash payments, international bank transferes, Bulgarian
company law, to name but a few.

Property planning, documents and deeds

During your initial stages of finding your home you will need the expert
advice on the valuation and condition of the property.

Points to be aware of:

• Is the property legally owned by the current owner?

• Is there more than 1 legal owner?

• Has the property been originally built with all the legal certification?

• Is the property structurally sound and legal if you are planning to add
an extension or renovation?

• Planning permission, building permission, legal documentation, land
registry, municipality and local court permission to build.

Bulgarian property deeds.

Only when you are completely satisfied will you be in a position to legally
place a deposit payment or a Bulgarian mortgage deposit to secure your
new home. You will need to be in possession of a legally signed receipt for
this deposit amount. A Bulgarian mortgage or home loan in Bulgaria can
be arranged for selected properties.

Bulgarian official translation

You will be given every opportunity to ask questions at every stage of the
transaction. A Bulgarian lawyer/Bulgarian solicitor, Bulgarian law
practice, a Bulgarian translator, Bulgarian court translator. All will be
in a position to answer legal questions before you sign legal documents.

Please understand that you cannot finalise your new property
transaction unless all the detailed legal documentation is in place.
You will be strongly advised by us to sign legal original and legal copies
of papers only in the presence of a fluent legally authorised and
registered translator who is prepared to sign all the legal documentation
giving you confirmation and a complete understanding at the time of
legal signing of property purchase deeds.

We will be here to guide you at every stage to ensure your complete legal
satisfaction and legal security with your property in Bulgaria.
